Many Ukrainians who have returned to Ukraine or spent some time in a third country are now asking whether they can receive S status again in Switzerland. Unfortunately, there is no single clear answer. Swiss migration authorities review each case individually and make decisions based on the specific circumstances.

Together with legal advisor Karina Pavlova, we have prepared an overview of the key points to keep in mind:

• in which situations S status may be granted again if a person returned to Ukraine but later had to leave

• what criteria the Swiss authorities consider (for example, whether a person lived in a so-called “safe region” of Ukraine and how applicants are distributed between cantons)

• when it may be possible to return to Switzerland after receiving temporary protection in another country

• in which situations professional legal advice may be necessary

Important: Even if you have clear and reasonable grounds, the final decision is always made by the Swiss migration authorities.
